II. Definitions
Personal data means any information relating to an identified or identifiable natural person (the “data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
Processing means any operation or set of operations performed on personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.
III. General information on data processing
Below, we inform you about the processing of your personal data in connection with your visit to our website and the use of (online) forms, in particular in connection with registering for and holding events.
1. Visiting the website
a. Categories of personal data
When you access our website www.spe-ce.de, information is automatically sent by the browser used on your device to our website’s server. This information is temporarily stored in a so-called log file. The following information is recorded without any action on your part and stored until it is automatically deleted:
• IP address of the requesting device,
• date and time of access and time zone difference,
• name and URL of the retrieved file or the individual web page,
• website from which you visited us (referrer URL),
• browser used (e.g. type, version, language) and, if applicable, the operating system and interface of your device, as well as the name of your access provider,
• HTTP status code and access status, and
• amount of data transferred.
b. Purposes of processing
The above data is processed by us in particular for the following purposes:
• ensuring a smooth connection setup for the website,
• ensuring convenient use of our website,
• maintaining and restoring the security of the website and evaluating system security and stability,
• identifying technical disruptions or errors in electronic communications, and
• for other administrative purposes.
c. Legal bases
Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, unless such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data (Art. 6(1)(f) GDPR). Such legitimate interests include, in particular, enabling you to access the website and achieving the processing purposes stated in Section 1(b).
Furthermore, processing is necessary for the performance of a contract (in particular, the user relationship between you and us when visiting the website) to which the data subject is party (Art. 6(1)(b) GDPR).
2. Use of (online) forms as well as registration for and holding events
a. Categories of personal data
Our website provides various forms that can be used for (online) registration for our events (e.g. for award nights).
If you complete such a form and submit it to us, the data entered in the input screen will be transmitted to us and stored. This may include, in particular, the following data:
• participant data (last name, first name, title, telephone number, email address),
• company address (company name, company address),
• billing address (name, address, email address),
• data of table neighbours (first and last name),
• date and time of contact,
• data relating to hotel stay (travel date),
• other content of the communication.
Alternatively, you can contact us via the email address we provide. In this case, your personal data transmitted with the email will be stored.
b. Purposes of processing
The above data is processed by us in particular for the following purposes:
• processing the registration,
• holding and organising the respective event,
• issuing invoices and billing the participation fee,
• contacting participants,
• handling participants’ enquiries, and
• conducting the award evaluation.
c. Legal bases
Processing is necessary for the performance of a contract (in particular, the contract for participation in our event) to which the data subject is party, or in order to take steps at the request of the data subject prior to entering into a contract (Art. 6(1)(b) GDPR).
Furthermore, processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, unless such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data (Art. 6(1)(f) GDPR). Such legitimate interests include, in particular, enabling you to participate in our event and achieving the processing purposes stated in Section 2(b).
3. Jury communication and committee work
As part of jury activities, we process personal data of jury members, in particular names, email addresses, and communication contributions. As part of the collaboration, this data is made visible to the other jury members, in particular when sending minutes, evaluation documents, organisational information, and invitations to online meetings. Processing is carried out for the organisational implementation of the jury work and for documenting the evaluation process in accordance with Art. 6(1)(b) and (f) GDPR.
IV. Categories of recipients
Please note that we may transfer your personal data to third parties for the processing purposes stated above as follows:
• To processors: Certain service providers, such as IT support providers or hosting providers, will receive your personal data in order to process this data in accordance with corresponding instructions (so-called processors), insofar as this is necessary for the processing purposes set out above. In particular, we may also use processors for billing and communication administration. Processors are subject to obligations to implement appropriate technical and organisational security measures to protect the personal data and to process the personal data only as instructed.
• To certain third parties: In accordance with applicable law, we may transfer your personal data to third parties, such as authorities, courts, suppliers, or service providers.
V. Transfers to third countries
The personal data that we collect or otherwise process may be transferred to recipients within or outside the European Economic Area (so-called EEA) and processed by these recipients.
• For recipients outside the EEA, some of these recipients are located in countries for which an adequacy decision exists (in particular the United Kingdom, Switzerland, the United States of America (for participants in the EU-U.S. Data Privacy Framework Program)), so that an adequate level of data protection can generally be assumed.
• Other recipients outside the EEA may be located in countries that, from the perspective of European data protection law, do not provide an adequate level of data protection. We will take the necessary measures to ensure that transfers of personal data to countries outside the EEA and processing there are adequately protected. With regard to data transfers to countries that do not provide an adequate level of data protection, we base the transfer—where legally required—on suitable or appropriate safeguards, such as standard data protection clauses adopted by the European Commission or a supervisory authority, approved codes of conduct together with legally binding and enforceable commitments of the recipient, or approved certification mechanisms together with legally binding and enforceable commitments of the recipient.
VI. Storage period
Your personal data will be stored, in accordance with applicable law, to the extent necessary to fulfil our obligations and for the period necessary to achieve the purposes for which the personal data is collected. If we no longer need the personal data for the respective processing purpose, we will remove it from our systems and records and/or take steps to properly anonymise it so that you can no longer be identified from this data (unless we must retain your personal data to comply with legal or regulatory obligations to which we are subject, or in the event of (threatened) litigation with you or other legal proceedings).
VII. Data subject rights
1. Right of access
You may request information pursuant to Art. 15 GDPR about your personal data that we process.
2. Right to object
Pursuant to Art. 21 GDPR, you have the right to object on grounds relating to your particular situation (see below under VIII.).
3. Right to rectification
If the information relating to you is not (or is no longer) accurate, you may request rectification pursuant to Art. 16 GDPR. If your data is incomplete, you may request that it be completed.
4. Right to erasure
You may request the erasure of your personal data pursuant to Art. 17 GDPR.
5. Right to restriction of processing
Pursuant to Art. 18 GDPR, you have the right to request restriction of the processing of your personal data.
6. Right to lodge a complaint
If you believe that the processing of your personal data violates data protection law, you have the right, pursuant to Art. 77(1) GDPR, to lodge a complaint with a data protection supervisory authority of your choice. 7. Right to data portability
If the requirements of Art. 20(1) GDPR are met, you have the right to have data that we process by automated means on the basis of your consent or in performance of a contract provided to you or to a third party.
